ICJ Day 2: South Africa Seeks World Court Ruling on Israeli Occupation

The International Court of Justice (ICJ) is currently holding oral proceedings to address the legal implications of Israel’s occupation of Palestinian territories. Representatives from various countries, including South Africa, Algeria, Saudi Arabia, the Netherlands, Bangladesh, and Belgium, have presented their preliminary arguments in what is considered the largest case at the ICJ, with over 50 countries participating.

The Palestinian representatives have strongly asserted that Israel’s occupation of the West Bank, East Jerusalem, and Gaza Strip is illegal and must cease immediately, unconditionally, and entirely. On the other hand, Israel has chosen not to attend the hearings but submitted a written statement expressing concerns that an advisory opinion could hinder conflict resolution efforts.

South Africa has taken a prominent stance in advocating for the Palestinian people’s right to self-determination. Pieter Andreas Stemmet, Acting Chief State Law Adviser at the Department of International Relations and Cooperation, emphasized that the UN has recognized the inalienable right of Palestinians to self-determination. Stemmet condemned Israel’s expansion of settlement activity, citing violations of international conventions.

Drawing parallels to South Africa’s illegal presence in Namibia, Stemmet highlighted the legal consequences of Israel’s ongoing occupation of Palestinian territories, including East Jerusalem. He underscored the prohibition of apartheid, stating that it applies universally, including to Israel.

South Africa’s Ambassador to The Netherlands, Vusimuzi Madonsela, urged for an end to Israel’s violations against Palestinian territories. Madonsela emphasized the importance of the advisory opinion for Palestinians, pointing out the prolonged occupation conducted in defiance of international law.

The ongoing attacks on Gaza and Israel’s disregard for legal orders have raised concerns about when Israel’s impunity for rights violations will cease. The lack of international intervention in addressing these violations has been a point of contention during the proceedings.

As the oral proceedings continue at the ICJ, it is evident that the legal ramifications of Israel’s occupation of Palestinian territories are being closely scrutinized.
